1. SMS Messaging Services
Ship Smart Solutions ("we," "us," or "our") offers SMS (Short Message Service) text messaging to communicate with our customers regarding shipment updates, quotes, logistics information, and account notifications. By providing your phone number and opting in, you agree to these SMS Terms of Service.
2. Types of Messages
We may send the following types of SMS messages to you:
- Informational messages: Shipment status updates, pickup and delivery confirmations, tracking notifications.
- Transactional messages: Quote confirmations, account alerts, service-related notifications.
- Conversational messages: Responses to your inquiries sent via text message.
We do not send promotional or marketing SMS messages unless you separately and expressly consent to receive such messages.
3. Consent Requirements
To receive SMS messages from Ship Smart Solutions, you must provide express written consent. Consent is obtained through:
- A checkbox on our website contact form (unchecked by default).
- Verbal consent provided over the phone (logged with date/time).
- Written consent via email, paper form, or other documented method.
Consent is voluntary. You are not required to opt in to SMS messaging as a condition of receiving our services.
4. Standard Message Disclosures
By consenting to receive SMS from Ship Smart Solutions, you agree to the following:
- Opt-out: Reply STOP to any message to immediately opt out. You will receive a confirmation message.
- Help: Reply HELP to any message for assistance or support.
- Message & data rates: Message and data rates may apply depending on your wireless carrier and mobile plan.
- Frequency: Messaging frequency may vary based on your shipment activity and account interactions.
- Carrier: Carriers are not liable for delayed or undelivered messages.
5. Opt-Out and Revocation of Consent
You may opt out of receiving SMS messages at any time by:
- Replying STOP to any SMS message we send.
- Contacting us at (331) 215-4701 to request removal.
- Emailing operations@ship-solutions.net with your phone number and opt-out request.
Upon receiving your opt-out request, we will stop sending SMS messages to your number within 10 business days, except for transactional messages required by law.
6. Compliance with Regulations
Ship Smart Solutions complies with all applicable SMS messaging regulations, including carrier requirements set forth by the Texting Compliance Registry (TCR), TCPA (Telephone Consumer Protection Act), and other federal and state telecommunications regulations. We are registered with TCR and maintain valid 10DLC (10-Digit Long Code) registrations for all outbound messaging numbers.
7. Limitation of Liability
Ship Smart Solutions is not responsible for messages that are delayed, lost, or undelivered due to factors beyond our control, including but not limited to: wireless carrier outages, network congestion, device settings, or recipient phone number changes. We do not guarantee message delivery.
8. Changes to These Terms
We reserve the right to modify these SMS Terms of Service at any time. Changes will be effective upon posting to this page. Your continued consent to receive SMS messages after changes are posted constitutes acceptance of the updated terms.
